Ambu Inc. (referred to as “Ambu”, “We”, and/or “Our”) is committed to protecting your personal data and privacy and will take care of your personal data and process it pursuant to what is set forth in this Privacy Statement / Notice at Collection (“Notice”) and in accordance with all applicable personal data protection laws. This Notice is directed to US residents only and is governed by laws in the United States only.
This Notice describes the ways in which data about individual persons may be collected, used, disclosed, shared, transferred and stored by Ambu, why such data is collected, and how you can manage your own personal data. It describes Ambu’s data collection and management practices.
Ambu may at any time and in its sole discretion change, modify, or otherwise update this Notice without notification. The latest applicable version is available and can always be accessed at this site. If we update this Notice to adopt more permissive data practices, and we have your email address, we will, where required, send you an email notifying you of those update(s).

I. PERSONAL INFORMATION AMBU COLLECTS
What personal information we collect from you and how we use it depends on our relationship with you.
For purposes of this Notice, “personal information” means information reasonably related to you.
In the bulleted list below, we outline the categories of personal information we collect, the sources of the personal information, and our business and commercial purposes in processing that personal information.
Categories of sources of personal information include information that you voluntarily provide to Ambu, information required from you, information collected automatically, and information collected from third parties, including service and content providers, our affiliated companies and subsidiaries, business partners, tradeshows/conferences, and data intelligence platforms (collectively “Third-Party Sources”).
Contact Identifiers, such as your real name, email address, physical or postal address, telephone number, IP address, or personal identification number.

Professional or employment-related information, such as your job title, healthcare professional ID, place of employment, your curriculum vitae, work history, and education information.

Internet or other electronic network activity information, such as marketing data, your stated preferences for receiving Ambu’s newsletter and marketing communications, your viewing behavior with respect to our websites and marketing communications, your products of interest, product areas and/or other preferences in terms of content.

Commercial information, such as your transaction information, your purchase history, or history of products you have evaluated and/or tested in collaboration with us, or your purchasing histories or tendencies.

- Collaborate with you regarding the evaluation, testing and use of Ambu products.

Sensitive information, such as financial related information, including but not limited to credit card numbers in combination with the required security or access code or expiration date. (Processed by a third-party vendor as described below)

Purpose:
- Customers receive a secure payment link to complete their own payment transactions.
- Payment information is collected directly by a third-party vendor, Ambu does not use or disclose this information for any purpose that would trigger your right to limit its use or disclosure under California law. Customers are encouraged to view the privacy statement provided by the third-party vendor.
- Once payment is completed via the third-party vendor, the order will be fulfilled.
Cookie-related information, such as by storing small text files on your end device enabling us to track your movements within our websites, help us make our website more attractive to you, enable the use of certain functions, and share your cookie information for cross-contextual advertising purposes.

Purpose:
- Maintain, improve and provide the best experience on Ambu’s website.
- Compile and generate statistics about which areas of the website its users visit.
- Register your IP address (Ambu will not be able to see where you come from or where you are going on the internet after you leave our site).
- Track consumers across websites to provide targeted advertising.
- Share the consumer’s data with third parties for cross-contextual behavioral advertising.
II. HOW LONG AMBU KEEPS YOUR INFORMATION
Ambu will retain your personal information for as long as it is necessary for the purpose or purposes for which it is collected (e.g., for as long as you accept marketing communications from Ambu, or as long as necessary to comply with any applicable legal or regulatory obligations, resolve disputes, exercise our rights, conduct internal research, and enforce and comply with our agreements).
When your personal information is no longer necessary for the purpose for which it was collected, Ambu may either delete, de-identify, or aggregate it. However, if Ambu de-identifies or anonymizes your personal information (so that it can no longer be associated with you), the data may be processed and stored for a longer period.
III. HOW WE SHARE YOUR PERSONAL INFORMATION
We may provide your personal data to:
Our Service Providers. Our Service Providers will then process your personal data for us in accordance with a written contract between us and them. Examples of Service Providers include:
- Data Processors. Your personal information may be disclosed to partners of Ambu such as data processors, external suppliers or IT service providers, who deliver services on behalf of Ambu in relation to the distribution of newsletters, invitations to events, and product information. Ambu has engaged in data processing agreements with external suppliers and these suppliers process the personal information only on behalf of Ambu and in accordance with Ambu’s instructions. The data processing agreements ensure that Ambu controls the processing of your personal information, which takes place outside of Ambu. When Ambu uses data processors, Ambu ensures that they apply at a minimum the same level of data protection as Ambu. To the extent a data processor transfers your personal information outside of the United States, Ambu ensures that such transfer is carried out in accordance with applicable data protection laws and regulations.
- Distributors. Some data relating to your purchase of a product, including your contact information and which products you have purchased or shown interest in may be shared with your local distributor.
Ambu’s Legal Entities. To provide you with the best possible service and/or to the extent it is necessary to provide effective support, service, assistance and contact for marketing, your personal information may be shared with Ambu’s affiliates. Change in Organization. If Ambu decides to reorganize or divest its business through sale, merger or acquisition, or in connection with the sale or transfer of its products, any disclosure of your personal information in connection therewith will be in accordance with current applicable privacy laws and regulations for the purposes of collecting, using, storing, or sharing that information.
Legal Rights and Obligations. In certain limited circumstances, Ambu may need to disclose your personal information to comply with a legal obligation or demand, such as responding to a legal request for information, cooperating with law enforcement agencies concerning conduct that is alleged to have been in violation of federal, state or local law; or to exercise or defend against legal claims.
Third Parties. We may also share your personal information for cross-contextual advertising purposes, as set forth in our Cookie Notice. You have the option to opt out of the sharing of personal information for cross-contextual advertising purposes by choosing to customize your cookie settings and disallowing marketing cookies. Alternatively, you may opt out of the sharing of personal information for cross-contextual advertising purposes as explained in the “Your Rights and Choices” section below.
IV. LINKS TO OTHER WEBSITES
Ambu’s website may contain links to other websites or to integrated sites. This Notice does not address, and Ambu is not responsible for the privacy, information, or other practices of any third-party websites to which Ambu’s digital services may link, such as social media platforms, any app developer, app provider, operating system provider, wireless service provider, or device manufacturer. Ambu is not responsible for the contents of the websites of other companies or for the practices of such companies regarding the collection of personal data. When you visit other websites, you should read the owners' privacy policies on the protection of personal information and other relevant policies.
V. DATA SECURITY
Ambu maintains reasonable technical, administrative, and physical controls to secure any personal data that we collect and to protect against accidental loss, misuse or alteration.
While Ambu implements reasonable safeguards, Ambu cannot guarantee that unauthorized third parties will not gain access to your personal information; therefore, when submitting personal information through Ambu’s services, you must weigh both the benefits and the risks in deciding what personal information you send to us.
On some Ambu websites you will find forums, message boards, news groups, etc., and any information you disclose in these forums may become public. As such, you should exercise caution when disclosing your personal information.
VI. CHILDREN’S PRIVACY
Ambu does not knowingly collect or use any personal information directly from any individuals younger than 18 years old (“Children”) through Ambu’s services. Ambu does not knowingly allow Children to order its products, to communicate with Ambu, or to use any of Ambu’s online services. If you are a parent and become aware that your Child has provided Ambu with information, please contact Ambu using one of the methods specified below, and Ambu will work with you to address this issue.
VII. YOUR PRIVACY CHOICES AND RIGHTS
Ambu provides you with control over your personal data. If you wish to exercise your data rights, please use the contact information below to make requests. Ambu will consider your request in accordance with applicable laws. Your exercise of any of these rights will not change the way Ambu treats you.
With respect to personal data that Ambu may have collected about you, you may exercise your rights and make the following requests:
- Right to Access: You have the right to request that Ambu disclose to you the specific pieces of your personal data that it has collected about you.
- Right to Know What Personal Information is Being Collected: You have the right to request information about (1) the categories of personal data Ambu has collected about you; (2) the categories of sources from which your personal data is collected; (3) the business or commercial purpose for collecting, selling, or sharing personal data; (4) the categories of third parties to whom Ambu discloses your personal data and why.
- Right to Deletion Personal Information: You have the right to request that Ambu delete any personal data that Ambu has collected from you.
- Right to Correct Inaccurate Personal Information: You have the right to request that Ambu correct, change, update or fix any personal data that Ambu collected from you that is inaccurate or incomplete.
- Right to Know What Personal Information is Shared and to Whom: You may have the right to request that Ambu disclose to you (1) the categories of personal data that Ambu has collected about you; (2) the categories of personal data that Ambu has shared about you and the categories of third parties to whom the personal information was sold or shared; and (3) the categories of personal data that Ambu has disclosed about you for a business purpose and the categories of persons to whom your personal data was disclosed for a business purpose.
- Right of No Retaliation Following Opt Out or Exercise of Other Rights: You have the right not to receive discriminatory treatment if you exercise the rights conferred to you by applicable privacy law.
- Right to Opt Out of Sale or Sharing of Personal Information – You have the right to opt out of the sale or sharing of your personal information.
To protect your personal information, process your information and/or handle your requests, Ambu may ask you to provide additional personal information to verify your identity. You may enable an authorized agent to make requests on your behalf. Ambu may need to verify your authorized agent’s identity and may request proof of their authority to act on your behalf. In verifying an authorized agent’s ability to act on your behalf, Ambu may also require them to either verify their own identity with Ambu or directly confirm with Ambu that you provided an authorized agent permission to act on your behalf.
Global Privacy Controls. In addition to opting out of the sharing of personal information via your cookie settings or contacting us directly, you can also opt out via use of the Global Privacy Control (GPC) signal. If you have enabled GPC in your browser, we process that signal as a valid request to opt out of the sharing of your personal information. We do so using frictionless processing, meaning we do not require any further action from you to honor your request. This applies without impacting your ability to use our website and services.
Notice of Right to Opt-out of Newsletter and Marketing Communications. If you no longer wish to receive our newsletter or other marketing communications from Ambu, you may opt-out or unsubscribe by following the unsubscribe instructions included in the marketing communication.
